Hello all,
I am interested in talking to any counsel who have dealt with Rule 8-10 and DCF’s claim that it only applies to criminal matters and not child protection. The language of the Rule says criminal and juvenile. I would be interested in hearing from anyone who has argued this issue. Thank you.

A recent spate of serious juvenile crime, including a string of car thefts in which offenders fled police at high speeds and the slaying of an innocent 63-year-old man in Hartford, represent one of the most serious and brazen outbreaks in years. The spree led to assertions from top state law enforcement officials that laws adding 17-year-olds to juvenile court, and making it harder to lock-up juveniles or transfer them to adult court, have made Connecticut more dangerous.

Please be aware that as of February 3, 2017, a new HUD rule was implemented requiring each public housing agency administering public housing to implement a smoke-free policy. The purpose of the rule is to improve indoor air quality in public housing and to benefit the health of public housing residents, visitors and staff with the goal to improve health outcomes.

There has been a recent focus on the Los Angeles Unified School District's high school graduation rates, which have reached an all-time high that many attribute to the district's reliance on credit recovery. Credit recovery has gotten a bad rap for reducing the quality and rigor of education. At the October 2016 NAACP Board of Directors Meeting, the Board created the 12-member Charter School Task Force. After the November General Election, based upon the United States President-Elect’s campaign promise to expand privatization of public education, the officers were concerned that the 1954 Brown versus Board of Education victory that promised a quality education for all was at risk. As a result, the NAACP Board of Directors expanded the Task Force work to include protection of quality public education for all inner-city children. Thus, the Task for was renamed to be the Task Force on Quality Education.

In 2014, following a series of student suicides, Stamford Public Schools began looking at ways they could better support students' behavioral health and well being.

They contacted the Child Health and Development Institute of Connecticut (CHDI) to help review the district's strengths and areas of concern and began building a trauma-informed model for school mental health that is resulting in better outcomes for students.

The passage of ESSA turned control of the country's K-12 education system back over to the states, giving local legislatures more flexibility surrounding decisions about standards, assessments and other accountability measures. Since Congress passed ESSA, states have been busy writing their own accountability plans which have to be submitted for approval from the federal Department of Education no later than September 2017.

A new initiative to support justice-involved youth will provide advice and legal assistance in Hartford, Baltimore and New Orleans. The Center for Children's Advocacy has been selected for the fellowship awarded in Hartford, CT, with the award going to CCA attorney Marisa Halm. We know better.

This month, the State Department of Education presented data to the State Board of Education showing that 1,674 children in preschool through Grade 2 were suspended in the last school year - 1,674 small children.

This despite 2015 legislation that outlaws out-of-school suspensions for children in preschool through Grade 2, except for "conduct of a violent or sexual nature that endangers persons."

I pass along the following announcement from the FDA and the CDC regarding possible false test results for children who may be exposed to lead. The working below is from our colleagues at the National Health Law Project ... The state Department of Social Services has already indicated that re-testing younger children who might have received test results that could be inaccurate should be re-tested and that re-test will be covered under the Medicaid program as "medically necessary." The work I do supporting educators directly addresses the problem of expulsion and outplacement. I prefer to work through referrals and I am interested in how I may be of service to this population. Generally, I work with teachers, counselors, school psychologists and administration on understanding and meeting the needs of young children rather than reacting to their behavior. This requires a lot of support in technique but also in the self-care and self-regulation of the teacher. I prefer to work systemically, and deeply, from administration on down, within a district or school to provide lasting change, rather than a

10 years. My current case, is helping a young in middle school stop being
bulled and get a one to one with him. While doing that their is alot of

A new federal audit released Tuesday said the state's child-protection agency struggles to accurately assess risky households, and was inconsistent when it comes to effectively interviewing child victims or vetting the fitness of relatives to serve as foster parents.

The review also said the Department of Children and Families was hampered by a shortage of traditional, or "stranger" foster-care families, and that, as a result, too many children were experiencing multiple foster-care placements.

Friends, the fight for racial justice in CT needs us right now.
It's Friday afternoon, it's gray, rainy and ugly outside. But the Center for Children's Advocacy needs your help.

We will be submitting written testimony in support of this Bill to expand the law so that officers in CT must collect racial profiling data on pedestrian stops, not just traffic stops. We have heard countless stories over the years of our young people being stopped for no reason while walking home and of our young people getting ticketed for jaywalking. Help pass Raised Bill No. HB 7307 - An Act Concerning Racial Profiling

Racial profiling data is currently collected on traffic stops made by police.

But what about racial profiling that takes place during pedestrian stops on the street?

Collecting data only on traffic stops creates an predominantly adult-oriented view of potential racial profiling, omitting any stops that impact a youth under 16 or someone who does not drive. Studies show that repeated stops by law enforcement can have an intense and damaging impact on the mental health of youths.

The landmark Sheff v. O'Neill lawsuit is rightfully lauded for forcing the state to offer Hartford's children of color options they didn't have before it was filed in 1989. Today, nearly half of Hartford's students attend high-quality integrated schools.

But more than half don't.

With college application season upon us, the Education Commission of the States has released a 50 state review of tuition assistance programs for youth pursuing postsecondary education. To date, only 28 states have some sort of financial aid programs specifically targeted for foster youth - 20 states with a tuition waiver program and eight states with a scholarship or grant program. See below for the policy brief and an interactive data visualization which breaks this information down by state.

In a report just released today, The Hidden Cost of California's Harsh School Discipline, authored by Russell W. Rumberger and Daniel J. Losen of the Civil Rights Project, the authors followed a single cohort of California 10th grade students through high school for three years to develop the study. They discovered that students who were suspended had only a 60 percent graduation rate, far below the 83 percent graduation rate for non-suspended students. Researchers then controlled for other common predictors of dropping out of high school to isolate the unique effect of school suspensions. They concluded that suspensions alone result

Yesterday, Governor Malloy held a Roundtable Discussion with Meriden Public Schools and other stakeholders to talk about a pilot program implemented in Meriden where high school students learned about the legal rights of students experiencing homeless during an advisory period. Through a series of short videos and discussion guides, students and teachers heard about the prevalence of youth homelessness, the legal rights of students experiencing homelessness and what steps to take for assistance.

Feds: Condo Must Allow Disabled Student’s Bus on Property

The mother of a teenager with medical and behavioral disabilities knew something was wrong when the board at her condo complex on the Berlin Turnpike voted to ban school buses from coming on the property.

She called a children’s rights lawyer, Bonnie Roswig, who told the condo association that she was pretty sure the feds would consider the door-to-door arrangement to be a reasonable accommodation – the pivotal phrase in
fair-housing and disability laws. Roswig, of the Center for Children’s Advocacy in Hartford, was right.

"Addressing the truancy problem isn't just about getting kids to go to school and fill a seat. It's about improving their grades, equipping them for their future and getting them to the finish line - graduation," said Hector Glynn, The Village vice president of programs.

The Truancy Prevention Project is a partnership between The Village, the Center for Children's Advocacy, the Connecticut Judicial Branch, and Hartford Public Schools.

"In the first days after the 2016 presidential election, the Southern Poverty Law Center's Teaching Tolerance project administered an online survey to K-12 educators from across the country. Over 10,000 teachers, counselors, administrators and others who work in schools have responded. The survey data indicate that the results of the election are having a profoundly negative impact on schools and students. Ninety percent of educators report that school climate has been negatively affected, and most of them believe it will have a long-lasting impact. From an attorney who has taken this training: "The Center for Children's Advocacy is offering training in Hartford in January and February to represent children who are seeking special immigrant juvenile status because they are victims of abandonment, abuse or neglect. The training is excellent and CCA lawyers also provide ongoing supervision. These cases are far less time-consuming than the average asylum application and the needs of the clients are compelling, even more so now than before."

Today, The U.S. Department of Education announced the release of new guides and resources to help justice-involved youth transition back to traditional school settings. The resources include a guide written for incarcerated youth; a newly updated transition toolkit and resource guide for practitioners in juvenile justice facilities; a document detailing education programs in juvenile justice facilities from the most recent Civil Rights Data Collection; and a website that provides technical assistance to support youth with disabilities with transitioning out of juvenile justice facilities.

Many thanks to the generous volunteers and agencies who made the Center's fall "Keep the Power On" utility clinic such a huge success. Over 70 families, whose households included over 100 children, will have access to heat and light security over the coming winter months.

Approximately 7,651 children are abused or neglected each year in Connecticut. Many children suffer in silence because they do not know where to turn for help. CCA helped draft PA 16-188, which mandates posting of the DCF Careline number and internet address in schools to assist children and youth suffering from sexual and physical abuse and neglect by informing them about assistance available and how to access it. Schools must post the information in a conspicuous location and in various languages that are appropriate to the school's population.

A complaint filed last month with DSS by the Center for Children's Advocacy is typical of the issues that have plagued (LogistiCare non-emergency medical transport) service, advocates said.

A child with cancer was ready to go to the hospital for a chemotherapy appointment. The child and the parents waited two hours for the cab to arrive. The parents had the form, created by Logisticare, that bore the doctor's signature saying the child was too medically compromised ... according to Bonnie Roswig, a lawyer with the Center for Children's Advocacy.

Children's rights lawyer Martha Stone and other advocates have said that for the $545,000 annual cost of confining one boy at the training school, the state could fashion an individual treatment plan for each of those youths and be more successful. Parole officers over the last year have pointed to an increasing recidivism rate at CJTS and said many boys who have passed through there are graduating to the adult prison system.

The Center's utility clinic is this afternoon at St. Francis Hospital. The clinic works to assist families avoid heat and electric service termination. Applications for Operation Fuel and Energy Assistance will be taken on site. The Regional School Choice Office representative will be available to assist with applications for the magnet school lottery. Other agencies will also be available to assist with basic needs.
Flyers in Spanish and in English are attached. Registration is not required. Please call me if you need additional information.

The Child Health and Development Institute of Connecticut, a Farmington-based nonprofit, is leading an initiative to train child care providers and others who work with young children to recognize signs of trauma – and to expand the availability of services to help. It’s funded by a $2 million grant from the federal Substance Abuse and Mental Health Services Administration.

"A recent study from Northwestern University suggests that the stress of racial discrimination may partly explain the persistent gaps in academic performance between some nonwhite students, mainly black and Latino youth, and their white counterparts. The team of researchers found that the physiological response to race-based stressors-be it perceived racial prejudice, or the drive to outperform negative stereotypes-leads the body to pump out more stress hormones in adolescents from traditionally marginalized groups. Ten years have gone by, but Lisa Vincent and her son, Jose, flash back to their goodbye with fresh anguish and faltering voices. He is 21 now, but the 11-year-old boy .. easily re-surfaces, all anger and confusion.

Hi all

I have a quick question and was hoping one of you may know the answer.

We have a significantly complex special needs infant in our practice who
lives in a family with multiple children. (7 people in family total). He
(as well as the family) desperately needs private duty nursing but it is an
excluded benefit on the private insurance for both parents' insurance. His
care is quite overwhelming and feel that they are not giving the best care
to all the other children including his twin brother.

The Center for Children's Advocacy was instrumental in writing and helping achieve passage of Connecticut Law Prohibiting Out-Of-School Suspensions and Expulsions for Very Young Children<http://www.cga.ct.gov/2015/ACT/PA/2015PA-00096-R00SB-01053-PA.htm>. Public Act 15-96 prohibits most out-of-school suspensions and expulsions for students enrolled in a preschool program or in kindergarten through grade two.

I was contacted recently by a frustrated applicant to one of the state’s technical high schools and her parents. The student was denied admission despite solid academic performance in mainstream programs for reason that the school admissions staff did not think the school could accommodate her.

I am involved in a case where a student was told they could no longer stay at a technical school because the school thought the student should qualify for special education (after attending the school for two years), informed the parents the school does not offer special education and therefore the student must find another school. "New Visions has a principal, classrooms and teachers but it is not a school," the state said in its report dated Wednesday. "New Visions is, in essence, a 2-hour guided study hall..."

The Hartford School Board voted to "demagnetize" Hartford's Journalism and Media Academy.

Martha Stone said Hartford officials had not consulted Sheff plaintiffs on the proposal to demagnetize Journalism and Media Academy. "It's a premature decision," she said...

Stone also expressed alarm over the board's pointed tone in its resolution, which she considered "needlessly inflammatory."

A new policy from the Social Security Administration (SSA) went into effect on August 1st to allow foster youth of all ages with disabilities to apply for Supplemental Security Income (SSI) benefits six months before they leave care. Twenty-six states and the District of Columbia need some degree of support in meeting the requirements of the Individuals with Disabilities Education Act, according to the U.S. Department of Education's most recent evaluation of state performance<http://www2.ed.gov/fund/data/report/idea/ideafactsheet-determinations-2016.pdf>.

For the third year in a row, the Education Department evaluated states on the academic outcomes of students 3-21 with disabilities-so-called "results" data-in addition to how well the states met the rules and regulations spelled out in the IDEA.

BRIDGEPORT — The district is still not providing adequate and timely plans and services for its most vulnerable students, a year-long state investigation has concluded.

Prompted by a complaint filed a year ago on behalf eight students receiving special education by the Center for Children’s Advocacy, the state probe found that while the issues raised by those students have been settled or withdrawn, there remains systematic concerns in how the district complies with both state and federal special education mandates.

Just over 20 years ago, on July 9, 1996, the state Supreme Court found that the school systems in Hartford and surrounding suburbs were unconstitutionally segregated. And although much progress has been made, the state has a long way to go.

Implementing a satisfactory plan to desegregate Hartford's schools has been a significant and expensive challenge for the state since the landmark Sheff v. O'Neill lawsuit was settled in 2003. More than a decade and $2 billion later, nearly half of Hartford's 21,000 students have access to schools where at least 25 percent of the student body is non-minority.

Public Act 16-66 requires Governor Malloy, no later than July 1, 2017, to designate a nonprofit entity to be Connecticut's Protection and Advocacy (P&A) system that will replace the Office of Protection and Advocacy for Persons with Disabilities, which will be abolished by law on July 1, 2017. Public Act 16-66 also requires the Office of Policy and Management (OPM) to issue a Request for Information to solicit information from nonprofit entities as to their capacity to be Connecticut's P&A system.

Coming Together to Address the Intersection of Juvenile Justice and Youth Homelessness

Each year, an estimated 380,000 children below the age of 18 are alone, without their families or a place to call home. Many of these children will come into contact with the juvenile justice system. Interviews with 654 runaway and homeless youth revealed that nearly 44 percent had stayed in a jail, prison, or juvenile detention facility, and nearly 78 percent had at least one previous interaction with law enforcement.

Hello all,
Wondering if a hospital automatically does a referral to DCF when a minor has a child? The minor child is 15 and will turn 16 next month. She is due sometime in October. I have had several cases involving pregnant minors and the referrals were from the hospital. I wanted to find out whether there is a mandatory Referral from the hospital or is it discretionary? Thanks in advance for any responses.

Federal law requires that hospitals report "high risk newborns" to the CPS agency. Minors are probably considered high risk by most hospitals.

The Connecticut House and Senate unanimously passed the bill introduced by the Center and New Haven Legal Assistance that mandates that an RFP be issued for the next Medicaid transportation contract. Jon Lender's column in the Sunday Hartford Courant (see below) notes the continuing abysmal level of performance by the current contractor, the Center's complaint to the Justice Department and the issues around the bidding process.

Utility Clinics Protect Vulnerable Families

Over 150 children will have their utilities protected based on the success of this spring's Keep the Power On utility clinics. Clinics for families facing termination of their lights and heat were held in conjunction with our clinical partners at Connecticut Children's Medical Center, Yale New Haven Hospital and The Hospital of Central Connecticut in New Britain. Pro Bono volunteers from the Aetna Legal Department, Pullman & Comley, LLC, Murtha, Culina, LLP and the University of Connecticut and Yale Law Schools provided counseling and support for participating clients. Families were also able to obtain additional services from Community Resource Team

Nearly 30 percent of juveniles arrested today are girls or young women, and their share of arrests, detainment, and court cases has steadily increased over the past two decades. Girls of color and those living in poverty are increasingly over-represented in this trend. The Office of Juvenile Justice and Delinquency Prevention (OJJDP) released a Policy Guide on Girls in the Juvenile Justice System to educate states, tribes and local communities about efforts to improve responses to girls and young women in-or at risk of entering-the system.

Over the last five years, dozens of camps and programs have rejected children with diabetes even though it's a violation of the Americans With Disabilities Act, according to federal law officers, children's rights lawyers and diabetes educators.

On Friday, in a "dear colleague" letter to school districts across the country, the U.S. Departments of Justice and Education made clear the obligations schools have to support transgender students under Title IX. The letter states that gender identity is included under Title IX protections and provides guidance that educators must respond immediately to harassment, honor students' gender identity, and allow students to participate in all aspects of school consistent with their gender identity.

The Center for Children's Advocacy will be holding two more utility clinics this spring. Below are details about the clinics and attached are flyers in English and in Spanish about each clinic.

Clients will get assistance with negotiating utility bills as well as assistance with budget counseling. Community agencies will be on site to provide services and support. All clients are welcome. P lease forward these flyers to interested clients and colleagues.

question about child's transition from DCF to DMHAS

The child will turn 18yo in three-four weeks and has a voluntary services
case with DCF. The guardian (a relative) refuses to house the child, the
child is presently in a shelter, and DCF is saying that it is arranging for
the child to transition to DMHAS services for housing (etc.) once she turns
eighteen. I am the outpatient therapist. My question: can DCF transition a
child to DMHAS who is not a ward of the state, or do the guardian's rights
have to be terminated first, with a subsequent petition for DCF to take
custody, so that at the

Good morning. I have attached what I believe is the most recent MOA between DCF and DMHAS as well as two memos from the DCF commissioner in 2011 (I believe these are the most recent on the issue as well). DCF can continue services for children in the voluntary services program beyond 18 and they can transfer children in the voluntary services program to DMHAS under the MOA. While I think the guardian's refusal to house the child prior to the age of 18 constitutes neglect, in all likelihood, if a petition were filed today, it would like be moot
